ACCRA – Manhyia South lawmaker, Nana Agyei Baffour Awuah, has disagreed with suggestions that a Chief Justice who is removed from office for stated misbehaviour should automatically lose their position as a Justice of the Supreme Court.

In a conversation with Moro Awudu on Metro TV’s Inside Pages on Saturday, September 20, 2025, Baffour Awuah argued that the office of the Chief Justice is an administrative position and must be treated separately from the judicial role of a Supreme Court judge.

“For you to appreciate what we are dealing with, you need to know that the role of the Chief Justice is an administrative role. The Chief Justice does not act as a judge in that position,” he said.

He explained that misconduct in the administrative role of Chief Justice does not necessarily mean misconduct as a judge.

“If the allegation against me for stated misbehaviour is not in relation to my office as a judge, which is making judicial pronouncements and interrogating matters judicially, it should not affect me,” he said.

The Manhyia South MP dismissed the popular analogy that compares the situation to a “chief driver” dismissed for drunkenness who then seeks to revert to being a “senior driver.”

“Such an example is like comparing apples with oranges,” he said. “Being Chief Justice and being a Justice of the Supreme Court are two distinct roles.”

Baffour Awuah further stressed that if the Article 146 committee did not recommend removal from the Supreme Court bench, the president cannot take that step.

“The committee did not find that I misbehaved as a Justice of the Supreme Court, for which reason no recommendation was made for my removal as a justice. My position is that the President cannot go beyond what the committee recommended,” he said.

He warned that going beyond the committee’s findings would amount to a constitutional breach and could set a dangerous precedent.

“Constitutional breaches, if you allow one, the next moment there will be another breach. Before you realise, the Constitution is no more. And that is why it is always important to protect the sanctity of the Constitution,” he said.
