Parliamentary Committee Opens Consultations on Contentious Anti-LGBTQI+ Bill

The Parliament of Ghana’s Constitutional, Legal, and Parliamentary Affairs Committee has officially opened the stakeholder consultation phase for the Promotion of Proper Human Sexual Rights and Ghanaian Family Values Bill. This stage represents a pivotal moment in the legislative process for the Private Member’s Bill, which remains a subject of intense national debate.

The Committee is engaging a wide array of stakeholders, including religious institutions, civil society organizations, human rights advocates, and professional bodies. The objective is to solicit diverse perspectives on the proposed legislation, which aims to criminalize LGBTQI+ activities, the promotion of such acts, and the support of related organizations.

Proponents of the Bill maintain that the legislation is a necessary intervention to protect Ghana’s traditional family values and social structures from perceived external pressures. They argue that legislative action is required to uphold the cultural fabric of the nation.

Conversely, the Bill faces stiff opposition from various human rights groups and international observers. Critics argue that the proposed measures would violate fundamental rights guaranteed under the 1992 Constitution of Ghana, including the rights to free speech, association, and assembly. Furthermore, legal and economic experts have highlighted potential diplomatic and financial consequences, noting concerns raised by the Ministry of Finance regarding the potential impact on international funding and foreign development assistance.

As the Committee navigates these opposing viewpoints, it faces the complex task of reconciling overwhelming public support for the Bill with the necessity of aligning the final legislation with Ghana’s constitutional mandates and international human rights obligations. The hearings serve as the definitive platform for examining the specific clauses regarding the criminalization of LGBTQI+ identities.

The outcome of these deliberations will determine the path forward for the legislation, carrying significant implications for both the nation’s social landscape and its legal framework.
