Afenyo-Markin cautions judges to uphold independence, cites Article 296

Minority Leader Alexander Afenyo-Markin has issued a strong caution to members of the judiciary, urging them to remain independent and faithful to their constitutional mandate in the discharge of their duties.

In a tweet addressed to “all Honourable Judges of our Courts,” he warned against acting on external influence or undisclosed directives, stressing that such actions could have lasting consequences.

“Know that if you follow unseen instructions or act on ‘yes sir massa’ orders, you will be on your own. Your decisions shall become part of the public record and posterity will judge you accordingly,” he stated.

He further urged judges to rely on their legal expertise, common sense, and judicial oath in delivering justice.

“Please apply your legal brain, common sense and abide by your judicial oath. Your Court is a Court of Justice! Article 296 must guide you,” he added.

Touching on the political climate, the Minority Leader asserted that the National Democratic Congress (NDC) government would exit power in 2028, advising judges to steer clear of political entanglements.

“The NDC government is on its way out of power. The tables will turn in 2028. For your own peace, stay away from politics. Let politicians do their politics and simply observe,” he noted.

His comments come amid ongoing public discourse on judicial independence and the role of the courts in Ghana’s democratic governance.
