Private legal practitioner, Kwame Adofo, has described the latest press briefing by the Office of the Special Prosecutor (OSP) on the Strategic Mobilisation Ghana Limited (SML) deal as a “knee-jerk reaction” aimed at deflecting public pressure.

Speaking on The Asaase Breakfast Show on Friday (31 October), Adofo questioned the credibility and timing of the OSP’s announcement that former Finance Minister Ken Ofori-Atta could be charged with corruption-related offences by the end of November.

“Why end of November? If you’ve identified someone as having committed a serious offence, charge them now. Why wait?” he argued.

The lawyer expressed doubt about the OSP’s handling of the investigation, describing it as politically motivated and lacking urgency.

“It’s just a decoy to divert attention. If he truly has evidence, he should proceed to court instead of holding press conferences,” Adofo said.

He further accused the OSP of misunderstanding its constitutional limits, reminding the office that prosecutions on behalf of the state must be sanctioned by the Attorney General.

“Article 88 is clear. The Attorney General is the OSP’s boss. He cannot claim to ‘collaborate’ as if they are equals,” he emphasised.

Adofo maintained that the OSP’s public commentary risks undermining due process, stressing that any credible evidence — including email trails or payment approvals — must be presented in court, not before the media.
